Newsletter means a regular email sent to provide information or updates about a product or Service, received by subscribers.

Personal Data or Personal Information means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. For the purposes of this Privacy Policy, there is no distinction between the terms Personal Data and Personal Information.

Processing or Data Processing means any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission or dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Processor or Data Processor means any natural person, legal entity or public authority to whom/which a controller delegates certain processing-related duties under the law or on the basis of a contract.

Social Media Account means Accounts, profiles, pages or registrations on Social Media or social networking Services.

Third Party means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorized to process Personal Data.

Restriction of Processing means the marking of stored Personal Data with the aim of limiting their processing in the future.

Web Beacon (also known as a tracking pixel, pixel tag or web bug) means a small resource embedded in a webpage or email that enables the operator to detect when the content is viewed and collect basic interaction and technical data.

1.1. We at ZajamNajam (‘we’, ‘us’, ‘our’ or ‘ZajamNajam’) value your privacy and we are committed to taking care of your Personal Data. Safeguarding your Personal Data and compliance with relevant data protection laws and regulations are responsibilities we take very seriously.

1.2. This Privacy Policy describes how the operator of the Website ZajamNajam - Puls Invest doo, with headquarters in Niš, Republic of Serbia, company registration number: 21376221, tax number 110688215 - and its subsidiaries collect, use, process and share Personal Information.

1.3. The operator of the Website is the Data Controller of the Services provided through the Website.

1.4. This Privacy Policy applies to Users and Visitors (individually ‘you’) of the ZajamNajam Website, applications, Social Media Accounts and other Services (our ‘Services’). This Privacy Policy explains how we comply with EU legislation related to data protection (EU General Data Protection Regulation 2016/679 – GDPR) and the Law on Personal Data Protection of the Republic of Serbia (Official Gazette of the Republic of Serbia no. 87/2018).

1.5. When using our Services, you can choose to interact with Features or Services from Third Parties that operate independently from us (i.e. links to Third Party Websites). Please note that this Privacy Policy does not cover the use of Personal Data by Third Parties or their Services, and we do not take any Accountability for their practices in the area of Personal Data protection. We recommend that you review the privacy policies and practices of Third Parties.

1.6. Individuals with disabilities who are unable to access our Privacy Policy online may contact us to inquire how they can obtain a copy of our policy in another, more easily readable format.

1.7. Please note that your use of our Services provided on the ZajamNajam Website is subject to our User Agreement.

2. Personal Data We Collect

2.1. Personal Data refers to any information relating to an identified or identifiable living natural person, as defined in the Definitions of Terms section above. This means any information relating to you which allows us to identify you, relates to you, describes you, can be used to contact you, or could reasonably be connected directly or indirectly with you.

2.2. When you visit our Website, register an Account with us and use our Services provided on the Website, subscribe to our Marketing Communications or interact with us in relation to our Services, you may provide us with your Personal Data or we may obtain Personal Data about you.

2.3. We may collect the following categories of Personal Data directly from you:

(a) Personal identifiers and contact details (such as your name, age, date of birth, gender, address, e-mail address, phone number);

(b) Personal identifiers for the purpose of the KYC procedure (such as proof of identity, proof of address);

(d) Social Media data (if you choose to link your ZajamNajam Account with your Social Media Account, we may collect Personal Information such as name, age, photograph, and other Personal Data linked to your Social Media Account);

(f) Your published content and photos (such as any Personal Information you decide to publish via your Account and/or include about yourself or others);

(g) Your contacts and/or reservations (such as contact information of the people you add to or notify of your reservations or listing through the use of our Services);

(h) Submitted reviews (reviews you submit by any name or in connection with any Personal Information you publish by yourself or others);

(i) Correspondence data (such as conversations, questions, complaints or any other Personal Information that you submit to us);

(j) Marketing Communications and preferences (such as your e-mail address or phone number; you can always stop receiving our Marketing Communications at any time through any methods displayed as part of any communication between us or by unsubscribing the link in our e-mails to you);

(k) Internet and Website information (such as your use of our Website, the date and time of your visit and use of our Website, personal identification numbers, IP addresses, geolocation, usernames, device information, browser information, platform, operating system, search engine used and other system identifying pieces of information).

(l) Other Personal Information you may provide (any other information you provide about yourself or others through the use of our Services or through Third Party platforms).

2.4. Some of the Personal Data mentioned above, such as your identity proof or address proof, may be considered a special category of data under applicable law or in your local jurisdiction. Please be aware that this information may be required for the Account registration procedure in order for us to comply with KYC and AML regulations and standards.

2.5. Certain Features of our Services may prompt your browser or device to request access to your geolocation information. We do not process geolocation information without you giving us permission through your browser or device.

2.6. Copies of proof-of-identity documents and proof-of address documents are Personal Data and must be treated with a high level of protection. Please note that they are not automatically special categories of Personal Data. If, and only if, we must carry out specific technical processing of facial images (i.e. ID photo) for the purpose of uniquely identifying you, such Personal Data may be treated as special category of Personal Data. In such cases we shall apply additional safeguards and rely on an appropriate legal basis required by applicable law.

2.7. Where you have willingly and transparently consented to our processing of Personal Data and/or sensitive or special category of Personal Data, you have the right to revoke such consent at any time contacting our support team.

4. Who We Share Your Personal Data With?

4.1. For our Website to function properly and provide related Services, we may need to share your Personal Information with trusted Third Parties. This involves sharing information with Third Parties that support Service delivery.
